TERMS AND CONDITIONS FOR SUBSCRIPTION PROGRAM
- These are the terms and conditions for subscription programs across the 1-800-Flowers.com Family of Brands (“Subscription Terms”). By clicking on “Confirm Subscription” and/or otherwise placing a subscription order, you accept these Subscription Terms. These Subscription Terms are between you and the specific company within the 1-800-Flowers.com Family of Brands from which you are receiving your subscription (“Company”, “we”, “our” or “us”). For a list of companies within the 1-800Flowers.com Family of Brands that offer subscriptions and their applicable brands and websites, see below under “Brand-Specific Subscription Information”. Your use of the Company’s website is also governed by our Terms of Use and Privacy Notice, as well as all other applicable terms set forth on the Company’s website(s), all of which are incorporated herein.
- Your subscription will automatically create a new order in accordance with the delivery frequency schedule designated for your subscription, until you cancel your subscription using one of the methods outlined in these Subscription Terms. Additionally, some subscriptions may have a limited duration (e.g. 3-, 6-, 9-, or 12-month subscriptions), to the extent designated at the time of your subscription placement. Such limited-duration subscriptions will end at the conclusion of the designated duration, but can also be canceled at any time using one of the methods outlined in these Subscription Terms.
- You may cancel your subscription at any time, with such cancellation effective as of the next unprocessed order following our receipt of your cancellation. Refunds will not be provided for any orders that have already been processed. To cancel your subscription, see the “Brand-Specific Subscription Information” below. You may also cancel your subscription by logging into your Company account, navigating to “My Account” and “Manage Subscriptions”, and clicking “Cancel Subscription”.
- You may be able to pause or skip a future shipment under your subscription, depending on the availability of those options. In the event those options are available under your subscription, you may pause or skip a future shipment by navigating to and selecting the applicable option in your Company account and/or by contacting us via one of the other methods as outlined under “Brand-Specific Subscription Information” below. Your request to pause or skip a subscription shipment will be effective as of the next unprocessed order following our receipt of your request, and may be subject to additional limitations or restrictions.
- The credit card or other payment method used to purchase your first order will be held on file and charged for each subsequent order until you contact us via the methods outlined herein to cancel your subscription. If we cannot complete an order with the credit card or other payment method you used to create your subscription, then you authorize us to update your subscription with another credit card or payment method on file. If we are unable to complete your subscription order with the updated credit card or payment method, then the order may be canceled.
- We can change the cost of your subscription order at any time, in our sole discretion. Following your first order, we will send you an email notice prior to processing each subsequent subscription order. The notice will confirm the cost of the order and the estimated shipping/delivery date. Applicable taxes and (unless otherwise expressly indicated when you placed your subscription) applicable shipping, processing, and service charges are in addition to your applicable subscription order charge. See “Brand-Specific Information” below for more information.
- Your subscription is personal to you, and may not be assigned or transferred, or used for resale, profit, business or commercial purposes.
- For “Subscription Box” subscriptions, each shipment you receive under your subscription will include a variety of items, selected by us, for the specific Subscription Box subscription type that you have ordered. The contents of each shipment you receive may vary, and we make no guarantees regarding the volume or quantity of products in a shipment, nor that you will receive any particular product(s) in a shipment. You are responsible for reviewing the ingredients of each product you receive to avoid side effects, including allergic reactions.
- We reserve the right to make changes, modifications or additions to, and/or deletions from, these Subscription Terms, with or without notice, subject to applicable law. Your continued participation in the subscription program constitutes your acceptance of such changes, modifications, additions or deletions. If you do not agree to any changes, modifications, additions or deletions, you must cancel your subscription. We may also, with or without notice and in our sole discretion, terminate your subscription and/or the subscription program at any time, for any or no reason. In such event, you will only be charged for orders that have been shipped/delivered to you prior to such termination.
